Every professional specializes to some degree. For David Island, Ph.D.,
his unique qualifications, experience and special skills are in six areas.

1.  Witness Preparation

  1. We assist you to prepare witnesses for deposition.
  2. We evaluate videotaped depositions and written deposition transcripts.
  3. We write an analysis of and make recommendations for trial strategy and remediation work with your witnesses based on our review of tapes and documents.
  4. We consult with witnesses and the trial team prior to the deponents' deposition or the witness' trial testimony to provide them with suggestions and advice.
  5. We consult with attorneys about solving special witness problems.
  6. We conduct witness preparations sessions with witnesses and attorneys prior to deposition or trial testimony.
  7. We have significant experience working with foreign-language witnesses to help them overcome their fears and adjust to the customs and mores of American courts.

2.  Foreign Language Speaking Witness Preparation

  1. We provide the same witness preparation services above for foreign language speaking witnesses.
  2. We have deep experience working with foreign witnesses.
  3. We organize and assist in the entire preparation session.
  4. We take witnesses to the court to familiarize them with American courts and help them overcome fears.
  5. We assist the interpreter during preparation sessions in working with the witness.
  6. We provide feedback to the witness in sensitive personal performance areas.

3.  Case Analysis and Evaluation

  1. We review case documents, depositions, videotapes and other case materials.
  2. From our experience base we discuss the case from our experience base with the trial team.
  3. We write a brief report based on our evaluation of the materials provided and our understanding of the case.

4.  Jury Selection

  1. We provide an analysis of the venue, generally from our experience in the venue.
  2. We draft voir dire questions and help the trial team to rehearse voir dire.
  3. We design and prepare written juror questionnaires, including motions to adopt the questionnaire and arguments for its adoption.
  4. We evaluate completed juror questionnaires, using a realistic "strike profile" for our suggested peremptory and cause challenges.
  5. We join the trial team at jury selection to participate with them in making intelligent decisions about peremptory and cause challenges.
  6. We will attend the trial to monitor juror's acceptance of the case as well as to evaluate witnesses.
  7. We have in-depth experience in Batson and J.E.B. Challenges.

5.  Case Consultation

  1. We help you develop case strategy.
  2. We develop and refine case themes.
  3. We review and critique jury instructions.
  4. We review opening statements and closing arguments, offer our thoughts and criticism and help you to rehearse.
  5. We review and critique proposed verdict forms.
  6. We critique graphic concepts and graphic art that you have had prepared. We will recommend good graphic artists for your consideration.
  7. We help you utilize the graphics and visuals effectively

5.  Bench Trials

  1. Consult on your overall approach and strategy for the bench trial.
  2. Review documents, graphics and witness strengths and weaknesses.
  3. Assist you to prepare witnesses.
  4. Review your opening statement and closing argument.

6.  Mock Trials and Focus Groups

  1. We organize, develop and run focus groups and mock trials, from half-day focus groups to 3-day mock trials.
  2. We prepare all of the questionnaires and materials for the mock research events.
  3. We analyze data from the mock research events and write thorough and substantial reports, outlining the results and making recommendations.

Custom-Designed Services

ITC will custom-design any trial consulting service desired by our clients. For example, during days-long videotape depositions, we will review the previous day's depositions over night and offer suggestions for the following day's questioning. We will conduct opening statement workshops. We perform post-trial interviews of jurors in jurisdictions where such interviews are permitted. We will join you in advocacy training programs, design mock arbitration sessions, and monitor juror reactions to the case during trial.

Collaboration

ITC often works in collaboration with other independent trial consultants. For community attitude surveys, large mock trial research events and other services needing a large staff, we collaborate with other noted trial consultants and their staffs.
